Welcome to AirMotion ("we", "us", "our"). These Terms & Conditions govern your use of our website and the video production services we provide. By engaging AirMotion for a project, you ("Client", "you") agree to be bound by the terms outlined below.
We believe in keeping things simple, transparent, and fair. Please read these terms carefully before starting a project with us.
1. Scope of Work
AirMotion specializes in producing premium, custom explainer and demo videos for SaaS and AI products. The specific details of your project—including runtime, animation style, UI abstraction level, and deliverables—will be outlined in a separate written proposal, quote, or Statement of Work (SOW) provided to you after our discovery call.
2. Payment Terms
To ensure commitment from both sides and to secure your spot in our production schedule, we operate on a standard 50/50 payment structure:
- Upfront Deposit: A 50% non-refundable invoice must be paid before any production work (including deep-dive research and scriptwriting) begins.
- Final Balance: The remaining 50% balance is due upon your final approval of the completed video.
- Delivery: Final, unwatermarked high-resolution files will be delivered to you only after the final balance has been paid in full.
Invoices are strictly payable within 7 days of receipt unless otherwise agreed in writing.
3. The Production Process & Revisions
We use a structured, milestone-based approach to ensure you are involved at every step: Script ➔ Storyboard ➔ Illustrations/Design ➔ Animation ➔ Audio.
- Included Revisions: Our standard pricing includes two (2) rounds of complimentary revisions per stage.
- Approval Lock-in: Before moving to the next stage, we require your written approval on the current stage. Once a stage is approved, any later requests to change it will fall outside the original scope and incur additional fees. We will always quote these extra costs for your approval before proceeding.
4. Timelines & Client Responsibilities
A standard explainer video typically takes 3 to 5 weeks to complete. However, this timeline relies heavily on timely feedback.
- We request that you provide feedback or approvals within 2-3 business days at each stage.
- Delays in feedback will proportionally extend the final delivery date. If a project is delayed by the Client for more than 30 consecutive days without prior notice, AirMotion reserves the right to pause the project or issue an invoice for the work completed to date.
5. Ownership & Intellectual Property (IP)
- Final Deliverables: Upon receipt of the final 50% payment, the Client is granted full, exclusive, and perpetual global rights to use, broadcast, and distribute the final delivered video for any commercial purpose.
- Raw/Source Files: Unless explicitly stated in your proposal, working files (e.g., Adobe After Effects project files, raw illustrator files) remain the intellectual property of AirMotion and are not included in the standard deliverables. If you require source files, they can be purchased for an additional buyout fee.
- Third-Party Assets: Any licensed materials used (e.g., stock music, voiceovers, specific fonts) are transferred to you under the standard licensing agreements of their respective creators.
6. Portfolio & Promotional Use
We take immense pride in the work we do for our clients. Unless a separate Non-Disclosure Agreement (NDA) has been signed, AirMotion reserves the right to showcase the final, approved video (or excerpts from it) in our portfolio, website, social media channels, and marketing materials.
7. Confidentiality
We frequently work with pre-launch software and proprietary tools. AirMotion agrees to keep all non-public information, backend UI access, and product strategies shared by the Client strictly confidential. We are happy to sign a mutual NDA before our discovery call if required.
8. Project Cancellation
We hope it never comes to this, but either party may terminate the project if the other party breaches these terms.
- If you choose to cancel the project after work has commenced, the initial 50% deposit is retained to cover the time and resources already invested.
- If cancellation occurs in the later stages of production (e.g., during animation), AirMotion reserves the right to invoice for the proportionate amount of work completed beyond the initial deposit.
9. Limitation of Liability
AirMotion provides high-converting videos designed to boost your sales, but we cannot legally guarantee specific financial results, conversion rates, or metrics. Our liability to you for any claim arising out of this agreement shall not exceed the total amount paid by you to AirMotion for the specific project in question.
10. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of Lithuania. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Vilnius, Lithuania.
